June has been an extremely rewarding month and

we are looking forward to continuing our progress

in July with the continuation of the ‘Keys to

Success’ incentive and O2 mobilisation programme.

What is the BlackBerry Enterprise solution?

The BlackBerry internet mail service is aimed at small to medium-sized

business customers, who do not have the infrastructure of an I.T department

to manage full wireless email. Personal customers with internet based email

New Mobile Connect tariff and pricing structure

Early Re-signs on 12 & 18 month contracts

Vodafone are delighted to announce the re-structure of Vodafone

Mobile Connect price plans on 2nd July 2007, with the introduction of

Vodafone Mobile Broadband.

Avenir Telecom would like to remind you that commission on re-signs

will only be paid on or after the customers’ contract end date. If you

are in any doubt as to whether you will receive commission on an

re-sign please check prior to processing it. No re-signs should be

processed before a customers contract has expired. If this is done,

commission will not be paid.

These price plans are targeted at businesses of all sizes, with a

simplified structure enabling customers to choose a competitive price

plan to fit the way they work.

Vodafone Mobile Broadband consists of the following price plans:

Mobile Broadband 24 (Launched Delayed) - These 24 hour sessions

are now also available on home soil for occasional users or those

who’d like to try the technology without committing to ongoing regular

payments. Customers can sign a contract and pay nothing until they

chose to connect for a 24 hour session as there is no monthly line

rental commitment.

Mobile Broadband - Mobile Broadband offers flat rate monthly access

at £25 ex vat per month so customers can enjoy the freedom of being

connected all over the UK (over 80% population coverage) to

Vodafone’s fast and reliable 3G broadband network.

Anytime Price Plans

The Anytime range of price plans deliver great value and flexibility to

consumer customers. Anytime plans include text messages and

Passport as default on all plans (until further notice). Business

customers can also benefit from the Business service and Stop the

Clock (STC) as an added option. Customers can migrate to other legacy

price plans (9 month ‘no downward rule’ remains for new connections).

Customers can migrate to the current Anytime plans (if in commitment

subject to 6 month extension on their current contract, if out of

commitment no extension required). Terms and conditions apply.

The 2 options for roaming on the Mobile Broadband price plan are:

1) 24 hour session based roaming, at a cost of £8.50 ex vat per 24

hours on selected networks.

2) Per MB roaming, at a cost of £4.25 per MB ex vat, so only cost

effective for usage under 2MB.

Mobile Broadband Travel - For the extensive business traveller there’s

Mobile Broadband Travel. For a flat rate of £95 ex vat per month,

customers can benefit from bill predictability and 200MB on any

network where Vodafone UK has a data roaming agreement.

Vodafone acceptable proofs

Vodafone will no longer accept details of a credit or debit card as proof

of signature. Any credit or debit cards accepted as proof if ID must be

as full proof of ID and must be verified using chip and pin - not

signature. A minimum £10 transaction must be swiped. The card being

verified must belong to the applicant. The till receipt showing that the

card was Pin verified must then be attached to the contract.

Completing a Business Contract

Sharetime Plus Plans

Please note that when completing a Vodafone business contract for

connections with commitment terms greater than 12 months, you must

state the contract length clearly and in bold on the contract agreement

form. This should also be supported by a valid purchase order

detailing the same commitment and price plan information.

Sharetime Plus plans are targeted at the SME segment and deliver

greater value to customers with UK and international call rates and

cheap calls between office and company mobiles. The plans are

available on 12 and 24 month contracts with a 15% discount on

24 month contracts. Sharetime Plus customers have the ability to add

a text and data bundle to their plan. The bundle is added to the lead

handset and the sharer mobiles can then share the bundle. The

allowances are ‘either or’ e.g: Text 1400 = 1400 text or 74Mb of data or

a combination of both. See page 18 for text and data options.

Small Business Plans address the small business person's

requirement for good value flexible price plans with an option for a

Office 2 Mobile, enables customers to get cheap or free calls from their

office landlines to their company mobiles. Office 2 Mobile is available

on Sharetime Plus, Company Caller Plus and Commercial Caller Plus.

Office 2 Mobile only applies when Vodafone Virtual Fixed Link is used.

If a supplier other than Vodafone is used for this purpose then that

supplier's prices and terms and conditions will apply.

Option 1: Office 2 Mobile Basic

This is at no additional charge to the customer, they simply pay for

what they use. Cheap rates have been introduced for calling from the

office landlines to the company mobiles.

Option 2: Office 2 Mobile Small / Medium / Large

Customers commit to monthly spend. Committed spend provides a

bundle of minutes for all non-company mobile calls, with an out of

bundle rate (pence per minute) as the bundled minutes. Customers

also receive a bundle of minutes at no charge, for all company calls,

with an allocation of minutes (up to twice the number of non-company

minutes).

standard costs for data is £1.50 per MB.

Customers can choose to add any of the following Mobile Internet

bundles to their Sharetime Plus plan, which can be shared between

the users on a specific Sharetime Plus and Caller Plus price plans.

The Mobile Internet Extra Pack is added to the parent handset only.

Vodafone's mobile internet bundles can be shared amongst

employees, offering great value access the internet from their

handset. The standard out of bundle price is £1.50 per mb. Mobile

Internet Extra Packs do not include text messages.

Consumer price plan update

The B4B range of plans come with inclusive minutes and a free

promotional Any O2 Bolt On (normally £5) which offers free calls to

O2 mobiles including –intra company calls. The price plans are

available on 12, 24 and 36 month contract terms.

This month O2 introduce a 24 month price plan range to complement

the 12 and 18 month options. These plans will offer the same

inclusive bundle value as the 18 month equivalent plans however the

subscriptions are reduced by £5.

Customers will receive more inclusive minutes and greater value

when they sign a 24 / 36 month contract. The free promotional Any

subscribing to a pre 27 April 2007 Shared Minute Bolt On adds more

handsets to their account, they will continue to pay the pre 27 April

Five free music downloads on Mobile Jukebox

BlackBerry Connect

From 1st July new pay as you go and pay monthly customers buying a

Mobile Jukebox phone in July will get five free music downloads of

their choice. Customers will receive ‘credits’ in order to redeem the

five tracks of their choice. This promotion ties in with the re-launch of

Mobile Jukebox on 1st July, and it ends on 31st July. Customers free

tracks are just the same as any other track, except that they have just

30 days from the date that T-Mobile tell them that they have received

their credits to choose and download tracks. Tracks usually cost £1

each and browsing charges apply for accessing t-zones until and after

customers download a track.

BlackBerry Connect is an email solution that works with non-

BlackBerry devices like the Nokia E61, MDA Vario, MDA Vario II, Sony

Ericsson M600i, MDA Compact III, T-Mobile Ameo and MDA Mail.

T-Mobile is phasing out BlackBerry Connect and will not be launching

any new devices with the BlackBerry Connect email solution.

The BlackBerry Connect service continues as it is for existing

customers and new customers can be connected to BlackBerry

Connect devices already in the range until they come to end of life.

Existing devices with BlackBerry Connect that are in stock should

continue to be sold through. Once BlackBerry Connect devices have

come to end of life, customers who wish to upgrade and want Instant

Email can get a great BlackBerry handset such as the 8100 Pearl,

8700, 8800 and 7130, and Instant Email can be added on for as little

as £5.88 per month.

Mobile Jukebox is available to pay monthly, pay as you go and U-Fix

customers on a wide range of compatible phones including Sony

Ericsson W880i, Nokia N95 and 7373, Samsung D900. Sony Ericsson

phones, with their well-known Walkman® capabilities, are the most

recalled mobile music brand in the market and from 1st July, new Sony

Ericsson phones will have Mobile Jukebox and Track ID, which is a

feature that lets customers identify a song that they hear and then

enables them to buy it.

Nokia N95 Software update

If customers update the software on their N95, factory settings will

automatically be restored. If any customers have satellite navigation

functionality on their phone, they will need to reinstall the maps they

have paid for by clicking on the ‘map’ icon and following the

instructions, otherwise they may end up paying for the maps again.

Pay monthly customers

From 16th July to 31st September, new pay monthly customers have

the chance to win the phone of their choice through a weekly prize

draw once they’ve registered their email address on My T-Mobile. In

addition, they are entered into the weekly prize draw automatically

every week thereafter, which gives them numerous chances to win.

They will receive an email confirming their competition entry, and

winners will be called (within 28 days).

Replacement USB modem for laptops

Customers who once purchased a data card for their laptop and have

since then changed their laptop may find that their card will no longer

fit (as most slots are now smaller express slots on newer laptops).

This leaves them without access to their plan and in this situation

they should be advised to call Customer Service to purchase a SIM-

free USB modem for approximately £110 (inc. VAT). Customers can

simply use the SIM from their old data card in their new USB modem

which will give them back access to their plan. Please note this

service is only offered to customers already in commitment with T-

Mobile and the software on the modem is locked to T-Mobile.

Pay as you go customers

From 2nd July to 31st September, new pay as you go customers who

They will receive an email confirming their £2.50 free credit (which

may take up to 28 days to appear on the account).

Joining T-Mobile

07744 and 07755 numbers

From mid-June, T-Mobile is offering new customers a selection of

services for free - simply for joining the network. Pay monthly and pay

as you go (including SIM only) customers will have the opportunity to

trial and experience the services such as web‘n’walk, a mix of

downloads etc, for free during their first month with T-Mobile. The

services offered for free will change regularly as time goes on (some

services will be dependent on the customer’s phone).

T-Mobile has discovered that 07744 and 07755 numbers are being

used as international access numbers and calls to these numbers are

coming out of a customer’s price plan allowance. As international

calls are not included in plan allowances, on 1st June (after giving

customers who have been using these numbers 30 days’ notice) calls

to 07744 and 07755 numbers were removed from plan allowances.

Calls to all 07744 and 07755 numbers which have existed prior to 1st

June are now charged at 12p per minute (inc. VAT) for both pay

monthly and pay as you go customers –outside of their allowance.

Customers using these numbers will hear a message explaining the

charges before they are connected.

New pay as you go and SIM only customers must activate their phone

for the first time (by making a call, sending a text etc) and they are

then sent a text confirming they have received their reward.

New pay monthly customers who join Flext, Flext + web’n’walk,

Everyone, Free Time, U-Fix and U-Fix + web’n’walk must also activate

their phone to receive the confirmation text. From the text, customers

can click on a link through to a site where they can choose their free

downloads etc (browsing charges apply if they are not on

web’n’walk).

U-Fix credit policy

U-Fix customers who would have previously had to pay a deposit to

join U-Fix but no longer need to are being told at the point of

purchase that they can call Customer Service once they are connected

to be migrated on to another plan of their choice i.e. Flext. This is not

the case. They can only migrate once their credit class has improved -

based on their performance and profile which can be very different

between customers. One way they can do this is through regular and

prompt payment of their bills but please note there is no set period of

time for this before their credit class will be improved.

18 month handset re-sign bonus

An additional £25.00 bonus is paid to you when a customers

existing 18 month plan is extended for a further 18 months via an

re-sign.

24 month handset re-sign bonus

An additional £50.00 bonus is paid to you when a customers

existing 24 month plan is extended for a further 24 months via a

re-sign.

Business 1 plan migration policy

Customers who wish to migrate to ‘business 1 plan’ who currently

have a single handset account can only migrate on the bill date.

Customers that want to add new handsets to their account on

‘business 1 plan’ when migrating must wait until after their account

has been migrated - this is when the new handsets can be

connected.

For existing business customers in commitment on ‘everyone share’

and or ‘relax and share’:

1) migration to business 1 plan can occur once the account is more

than 3 months old

2) Same contract term applies; 12 month migrates to 12 months on

business 1-plan, 18 month migrates to 18 months on

business 1-plan etc

New Business Plans from Orange

Business Everywhere

Orange launched three sets of business plans at the end of May,

Orange Solo, Venture and Momentum. The Business Plus and

Business Advance plans will continue to run until the end of August.

Customers who sign up for longer contracts will receive additional

value from their plan, all contracts over 12 months will receive free

Orange Care and the old tenure discounts have been replaced by

additional in-bundle minutes.

Business Everywhere offers flexible data pricing. Customers pay a

fixed amount each month and in return receive competitive rates for

mobile network data usage (GPRS, EDGE and 3G) and wifi hotspot

data usage in the UK and abroad. In June three of the Business

Everywhere plans were refreshed to offer customers more inclusive

data, the changes were made to the Flexible Data 20, 25 and 65

plans. The way in which Orange communicate the Business

Orange Solo

Everywhere plans has changed to make it easier for customers to

understand. Even though Orange offers Flexible Data Pricing, they

recognise that most customers regard UK mobile network data as the

Orange Solo is aimed at single users, who are more likely to buy in a

retail environment. There are three price points and two contact

lengths for these customers, and as a promotion until 31/08/2007 all most important. Therefore in future communications, Orange intend

three price points offer an unlimited shout to make them competitive to include the maximum amount of data available if the plan was

with the consumer (Animal) plans. In addition to the unlimited offers

all Orange Solo customers qualify for free Orange Care, dedicated

business customer services, one month roll over of minutes (and

texts on £35/£40), no minimum call charge and free missed call

alerts.

Orange Re-sign Returns

Orange reserves the right to levy the following charges if in any

calendar month the number of handset re-signs which are cancelled

as a percentage of the number of handset re-signs in the same

calendar month exceed the thresholds set out below:

Orange Venture

Orange Venture is designed for the SoHo audience. This audience

typically has up to 10 employees and the companies tend to be run

by an owner-manager. To encourage customers to sign up to a longer

contract, Orange offer customers who sign up before 31/08/2007

extra inclusive minutes on 18 and 24 month contracts. All Orange

Venture customers will benefit from free Orange Answer phone, free

itemised billing, unlimited calls between sharers, mid-contract price

plan review, dedicated business customer services, flat rate out of

bundle rates, one month roll over of minutes, no minimum call

charge and free missed call alerts. The number of sharers is

dependent on the plan signed up for, and all sharers will be charged

at £15.

subsequently cancelled. The percentages will be calculated in

respect of mobile devices supplied by Orange only.

Orange Service Level Agreement

The Orange service level agreement to process connections is 24 - 48

hours. If however there are any delays to the Orange SLA and the

connection is made in the following month, then the new month’s

commission rates will be paid, regardless of whether the commission

rate has increased or decreased.

Orange Momentum

Orange Momentum is for larger companies, typically with over 10

employees. As communication between the staff is key to these

customers Orange Momentum offers free calls and texts between

sharers. The contract lengths for Orange Momentum have been set

at 12, 24 and 36 months as companies of this size tend to have an

annual buying cycle, and as a promotion for all customers joining on

a 24 or 36 month contract before 31/07/2007, they can chose from

either extra inclusive minutes or unlimited Orange to Orange calls

each month. Orange Momentum offers the capacity for up to 400

sharers with a flat rate sharer fee of £12.50. All Orange Momentum

customers will benefit from free Orange Answer phone, free itemised

billing, unlimited calls and texts between sharers, dedicated

business customer services, one month roll over of minutes, no

minimum call charge and free missed call alerts. Customers signing

up to Orange Momentum will be tied to their plan for the duration of

their contract.

Re-sign Commissions

The freephone trade support line and the sub-dealer line

There are five Re-sign Investment Classes, calculated on how

much the customer has spent in the last six months, the length

of time since the start of their last agreement and their contract

type.

Each customer will fall into one of the five classes, which will

then determine the level of commission payable to yourselves.

0161 380 0152 enables you to input your connector code and

use the automated service to get your customer's re-sign fee

and UIC, which translates into the commission. The prices given

are subject to the customer's eligibility to re-sign and are valid

only on the day that they're quoted.

Direct Debit only policy

3 implemented a Direct Debit only policy for post-pay customers

on the 7th December 2006. Under this policy, any failure to

instruction will amount to a breach of the customer registration

process. 3 will no longer pay commissions on post-pay

customers registered without valid bank account and sort code

details.

3 instigated this change in registration policy to help further

improve the overall quality of the business dealers and the

network do together.

50% Extra minutes offer on Business 600 and

Dealer Returns Policy and Procedure

A completed Avenir Telecom Returns Authorisation Form must accompany all returns. There will be a delay in

processing and/or the goods will be sent back to any customer of Avenir Telecom should this not be adhered to.

In addition, a carriage charge will be invoiced to any customer of Avenir Telecom for any phones sent back to any

customer of Avenir Telecom, for not conforming to the policies/procedures as detailed below.

¼ Invoices will be raised for any promotional items that are not

returned with the corresponding phones.

¼ From the 1st June 2005 if the Orange Returns Authorisations in

a given month exceed 5% of the net new connections in the

preceding month, Avenir Telecom reserve the right to

sent back to its customer(s). In addition, Avenir Telecom will pass

on any charges incurred to its customer(s).

Please note that all Orange phones are shipped with SIM cards

and these may not be exchanged i.e. each phone has a matching

sim and vice versa and these may not be swapped over with

other phones or SIM cards.

¼ Orange reserves the right to levy the following charges if in

any calendar month the number of handset re-signs which are

cancelled as a percentage of the number of handset re-signs in

the same calendar month exceed the thresholds set out

below:

5% or more but less than 10% = £20

10% or more = £50

Orange Phones

This charge will be levied for each handset re-sign which is

subsequently cancelled. The percentages will be calculated in

respect of mobile devices supplied by Orange only.

phones and will issue a credit accordingly. In such circumstances,

the following criteria will need to be met:

its customers if contents are missing, the box is damaged,

T-Mobile Phones

T-Mobile phones are sold on a non-return basis. However, Avenir

Telecom may, on occasion, on an ex gratia basis, accept returned

phones and will issue a credit accordingly. In such circumstances,

the following criteria will need to be met:

date of purchase and any seal must be intact and unbroken.

Unconnected phones returned must be fully boxed kit in new

condition. Avenir Telecom reserves the right not to credit any

¼ All Orange phones being returned to Avenir Telecom must be

accompanied with the original sim card issued with the phone

from the original date of sale.

¼ Previously connected Orange phones may be returned to Avenir

Telecom and a subsequent credit will be issued, however you

must request a Return Authorisation number from Orange prior

to doing this. For handsets where the connection was made

after the 1st June 2005, credit will only be issued if the handset

has a valid Orange Return Authorisation Number as well as an

Avenir Telecom Return Authorisation number. The Orange

Returns number is 07973 100272. The Orange Returns

Authorisation number must be requested within 14 days from

the date of connection, and any customer of Avenir Telecom

must subsequently return this to Avenir Telecom within 5 days

of collecting the Orange Returns Authorisation number.

¼ Dead On Arrival/Out of box failures can only be returned to

Avenir Telecom for credit provided an Orange Returns

Authorisation number has been obtained from Orange. Contact

Orange on 07973 100272 to obtain the Returns Authorisation

number.

¼ T-Mobile no longer operates any form of 14-day CSG, so no

goods will be accepted for credit under any 14-day CSG claims.

This applies to both PAYG and Contract.

¼ Avenir Telecom will reverse any credit given to any of its

customers should any returned phones be subsequently

refused credit by the network. Avenir Telecom would like to

remind you of the importance for all its customers to ensure

that stock is rotated and connected.

¼ T-Mobile now operates a returns cap for all phones returned.

This will apply when the total number of phones returned to

Avenir Telecom exceeds 4.5% of the total net connections in

the month. Any phones returned in excess of the cap will be

subject of a charge of £80.00 per phone and a corresponding

invoice will be raised to the relevant Avenir Telecom customer

¼ Unconnected phones returned must be fully boxed kit in new

condition. Avenir Telecom reserves the right not to credit any

of its customers if contents are missing, the box is damaged,

marked, has any adhesive stickers or labels affixed to it, or the

kit/box is considered to be in poor condition.

¼ 3 operates a 14 day money back scheme and a 14 day

exchange policy but will only accept fully boxed/complete kit

for credit accompanied by a 14 day exchange reference

number. This must be obtained from 3 customer services while

your customer is present. All 3 returns must be accompanied

with a 3 Customer Return form filled out and completed

together with the disconnection reference

(if applicable). The handset and completed return form must

reach ATUK within 5 days of the disconnection taking place.

0208 731 4470. 3 and Avenir Telecom will only provide credit

on returns that are UNUSED. This means handsets that have

not been used to make or receive calls, send or receive texts,

have downloads or any other content and are not damaged.

¼ Avenir Telecom will reverse any credit given to any of its

customers should any returned phones be subsequently

refused credit by the network. Avenir Telecom would like to

remind you of the importance for all its customers to ensure

that stock is rotated and connected.

Accessories/SIMs

Avenir Telecom only offers an exchange on a like for like basis on

any accessories.

¼ SIM cards can only be returned if faulty, within 30 days of

receipt.

¼ Orange Pay as you go connection packs require an Orange

Returns Authorisation number obtainable as outlined

previously in the Orange section.

¼ Accessories sent back must be accompanied by an Avenir

Telecom Returns Authorisation Form and the Avenir Telecom

invoice number (or copy of the invoice). If not, they may be

sent back and carriage charged accordingly.

Important changes to Avenir Telecom Terms

and Conditions

With immediate effect Avenir Telecom can no longer accept back

phones, accessories or SIMS which are not in our current stock or

Talking Shop brochure due to policy changes from all the

networks. No stock is sold on a sale or return basis and any

authorisation for return of stock is at the discretion of the Head

of Sales. All authorised returns must be sent back to us within 5

days of the Avenir Telecom Returns Authorisation Number being

given.

¼ All phones returned to Avenir Telecom must include all

components, accessories and/or auxiliary items that were

supplied at the date of sale. Should this not be adhered to, 3

are entitled to levy a charge against any customer of Avenir

Telecom for each missing component, accessories and/or

auxiliary items in accordance with the price list.

¼ 3 introduced a scheme to encourage 3 sellers to keep their

returns rate as low as possible. If the returns rate in a given

month exceeds 10%, Avenir Telecom reserves the right to

implement the following charges to any of its customers:

Commission Reclaims - Contract Connections

Please find below the various terms and conditions relating to commission reclaims

across the five UK networks with whom we currently operate.

the 1st February 2003, ATUK reserves the right to clawback

any commission following any connection or price plan

change when, in the sole belief of Orange, the connection or

disconnection has been made for the commercial gain of

either the customer or connecting dealer.

All Networks

ATUK reserves the right to raise a commission reclaim within

the following clauses of our full terms & conditions

¼ Where there is evidence of non compliance with the Service

Provider’s operational procedures as notified from time to

time.

¼ Any errors in commission payments can be reclaimed up to

12 months from date of connection.

¼ In respect of any Airtime Agreement where the end

customer’s call spend is lower than that reasonably

expected. The determination of ‘reasonable call spend’ to

be entirely at the discretion of the relevant Service

Provider.

¼ In respect of any connection where minimal call activity

takes place within a six calendar months’ billing period

from the relevant Service Provider from the date of

connection. The determination of ‘minimal call activity’ to

be entirely at the discretion of the relevant Service

Provider.

¼ If a phone is disconnected for whatever reason within 180

days from date of activation.*

¼ If a customer fails to pay the first 6 months bills in full.

¼ If a price plan is downgraded within 7 months on Vodafone

the additional commission will be reclaimed.

¼ If a price plan is downgraded within 7 months (consumer)

or 12 months (business) on O2, the additional commission

will be reclaimed.

¼ Where the connection has been identified by Vodafone/O2

as fraudulent.

¼ Where value added services are sold and subsequently

disconnected within 180 days (Vodafone) and 6 months

(O2) a commission reclaim will be applied.

¼ In respect of any Airtime Agreement where the Buyer does

not supply new units to the End Customer

¼ In respect of any Airtime Agreement procured via

unauthorised marketing activity on the part of the buyer.

¼ The Seller will clawback all and any amounts as may be

reclaimed by the Service Provider from the Seller from time

to time for any reason whatsoever.

¼ The relevant network and ATUK must approve all “gateway”

connections before any commission payments will be

made. Failure to disclose at point of credit check a

“gateway” application will invalidate the connection

resulting in the commission payment being withheld or

reclaimed without notice.

¼ Any errors in commission payments can be reclaimed up to

12 months from date of connection.

¼ If a request is made for proofs for SOHO customers only

and these are not supplied within 10 days of the request

being made.

¼ Where the connection is deemed to be for commercial gain.

¼ Where the connection has been identified by

T Mobile as fraudulent.

¼ Commitment VAS Pack disconnection clawback - If a

customer disconnects a commitment VAS pack after 31

days but before the end of the 5th month following the

month of connection (approx. 6 months) then the VAS pack

commission is clawed back.

¼ Non-Commitment VAS packs including business SOC - If the

VAS pack SOC is not active at the end of the 2nd month

following the month of connection (approx. 3 months) then

the VAS pack commission is clawed back.

¼ If a phone is disconnected within the first 14 days.

¼ If a request is made for proofs and these are not supplied

within 14 days of the request being made.

¼ Where the connection has been identified by Orange as

fraudulent.

¼ Where value added services are sold and subsequently

disconnected within three months.

¼ Due to an amendment to the terms and conditions from the

Orange network concerning provisions for clawbacks, as of

2nd month following the month of connection (approx. 3

months) and if migrated downwards (e.g. from 100 texts to

50 texts) then the difference in commission is clawed back

¼ Please note any customer that cancels within

approximately 90 days of connection will have the price

plan commission reclaimed.

With effect from 1st March 2004, for new connections, 3

reserve the right to clawback all commission payments

(including price plan and volume bonuses) for disconnections

due to fraud including non-payment since registration.

However, where a valid proof has not been presented to, and

accepted by 3 within 14 days of request, the commission

clawback will be reversed in full. A full list of proofs are

available from 3 Sellers website. 3 may clawback

¼ T-Mobile reserve the right to clawback any commission

paid to channel where in T-Mobiles sole discretion any

activity on the account results in the commercial gain of

either the customer or channel. This includes fraudulent

activity and/or account/tariff consolidation.

commissions up to 120 days after activation if the customer

defaults on the payment of their bills. This decision for non

payment is automated in 3’s systems through their collections

team who have the hold on this decision.

¼ Tariff discontinuation clawback - if a customer disconnects

after 31 days but before the end of the 5th month following

the month of connection (approx 6 months), then the tariff

bonus is clawed back within 90 days.

Commission Reclaims -

Payment Terms on Avenir Telecom Invoice

Notwithstanding any prior arrangements that you may have

reached with Avenir Telecom in respect of a credit account,

any invoices issued to you by Avenir Telecom in respect of any

commission reclaims from the airtime providers are due

immediately upon presentation. If you do not make an

immediate payment of the full amount claimed (including VAT)

Avenir Telecom reserves the right to make immediate offset

against any amounts that may be due from Avenir Telecom to

you.

Avenir Telecom may receive incorrect information from the networks and will obviously reclaim any commission that has been paid in

error. Never-pays may be deemed as fraudulent connections by the networks.

^The 120 days commences on the 1st day of the following month after connection.

Irrespective of stated Commission Reclaim terms Avenir Telecom reserves the right to reclaim any commission paid if any subsequent

disconnection or price plan change has been made for the commercial gain of the Buyer or the end user.
